Jamkattel moves SC against govt

KATHMANDU, Sept 16: UCPN (Maoist) trade union leader Salikram Jamkattel filed a writ petition at Supreme Court (SC) demanding stay order and scrap the government´s decision to withdraw charges against his attackers.



“I will be denied justice if the government decision to withdraw the case is implemented as the case is still sub judice in the courts,” the petition reads. [break]



Jamkattel was attacked in the Babar Mahal area of the capital last year. He was rushed to the nearby Norvic Hospital.



He then filed a case at Kathmandu District Court (KDC) demanding stern action against his alleged attackers--Taranidhi Pant, Ram Pudasaini, Kamal Bahadur Budhathoki, Indra Bahadur Shahi Thakuri and Sudip Karki--on November 20, 2011. However, the court released Pant on bail while the rest of attackers were sent to judicial custody.



Jamkattel moved to Patan Appellate Court demanding that Pant be sent to judicial custody along with others. The appellate court has sought necessary documents on the case from KDC.



In the meantime, the government has decided to withdraw charges against the alleged attackers on July 17 citing the case was politically motivated.
