After hearings on two writ petitions filed separately at the apex court, the single bench of Justice Sushila Karki ordered the president´s office and the office of the Interim Election Council, among other defendants, to respond to the SC regarding the decision.[break]
The SC has also called in the writ petitioners and the defendants for April 25 for discussions on whether the apex court should issue an interim order.
Advocates Gopal Siwakoti, Kedar Guragain and Kapil Chandra Kafle had moved the apex court demanding that the SC scrap the president´s order on removing constitutional difficulties and that the Interim Election Council led by Khil Raj Regmi be dissolved.
The writ petitioners have also urged the SC to order the formation of a national consensus government.
Similarly, Advocate Kanchan Krishna Neupane, in his writ petition, has claimed that the approval of the ordinance on removing constitutional difficulties was unconstitutional, arguing that the president´s powers to remove difficulties does not mean the power to amend the Interim Constitution and that rather it was meant to be used in case of any difficulties in implementing the constitution.
Both the writ petitions were filed at the apex court on March 14, the day Regmi was sworn in as chairman of the Interim Election Council.
The president´s office, the office of the Interim Election Council, the Ministry of Law and Justice, UCPN (Maoist) Chairman Pushpa Kamal Dahal, Nepali Congress President Sushil Koirala, CPN-UML Chairman Jhala Nath Khanal and leader of United Democratic Madhesi Front Bijay Kumar Gachchhadar have been named as defendants in the writ petitions.
