KATHMANDU, Nov 8: The Supreme Court (SC) has refused to issue an interim order on the writ petition filed against the government’s decision to remove Hitendra Dev Shakya from the post of Managing Director of the Nepal Electricity Authority (NEA).
A division bench of Justices Abdul Aziz Musalman and Nripadhwaj Niraula on Friday declined to grant the interim order.

“Since the substantive issues, facts, and legal questions raised in this writ petition are similar to previous petitions, and considering that the constitutional and legal questions raised by the petitioner can be adequately interpreted, assessed, and addressed during the final hearing and judgment of this case and related cases, it is appropriate and necessary to decide all these matters together. Therefore, an interim order as requested is not required at this stage,” the order reads.
The SC has scheduled the next hearing for 25 November.
Justice Niraula’s bench had earlier issued a show-cause order on November 4, asking the government to submit a written response within seven days, and had called both parties for a hearing on Friday.
Former NEA MD Shakya had filed the writ petition at the SC on Monday, claiming that the government had unlawfully removed him from his position and demanding his reinstatement.
Shakya had been appointed MD of NEA for a four-year term by the previous government. The current government had transferred him from the post.
